AT ASHEVILLE Charge Is Misappropriation: Ballard Charged, Indicted and Fined The Judicial Board met Monday, May 10, to decide the case of Carl Ballard vs. the S.G.A. The Board heard testimony by Noble Tony, and Ray Holden. Statements from the prosecution were accepte'd from Ed Rosenberg and President Coonan. Ballard made his statements for the defense. In the absence of Bill Punshon, Frank Rosen presided as the acting Judicial Board Chairman. B^ard was charged with three of missapropriation: an unauthorized and unexplained withdrawal of $50.00 from the WUNF “private” account; an account and willful negligence to deposit fare received by another passenger; and missapropriation of student funds to further private enterprise. Ballard pleaded not guilty to all counts. Ballard maintained that as business manager of the station he was an auSiorized signatory of the WUNF “private checking account.” “As business manager,” he could not be “charged with missappro- priation.” The prosecution maintained that Ballard was legally unauthorized charging of an air fare to the WUNF “general” 'accountable to the students and to business firms which donated to the station for proper use and recording of the funds received. The prosecution stated that the improper use of this responsibility constitutes the essence of missapropriation, and that Ballard misused his responsibility. Ballard was found guilty as charged of missappropriating $50.00. The Board did not explicitly rule on the other two charges. Ballard however, accepted the responsibility of dept to the SGA by paying the sum of $39.15, the balance due according to the remaining counts. The remaining charges were dropped upon payment of this sum. The Judicial Board did not specify how the decision levied against Ballard was to be enforced. According to Financial Commissioner Ed Rosenberg and his assistant, Tom Barrett, there are three apparent cases of misappropriation charged against Ballard: an unexplained withdrawal on a deposit slip; a charge involving apparently unauthorised use of station funds to cover the fare for an air trip to Kentucky, and an item involving the use of SGA funds to purchase parts for private repairs. In recent interviews with Ballard, Ray Holden, Bill Coonan, Rosenberg, David Anders, Barrett, Jim Cochran, and Steve Fricke, The Ridgerunner attempted to clarify the bases for the allegations against Ballard. Rosenberg asserted that three firms in'the Asheville area had been solicited for advertisement funding. Donations amounted to $100.00 in checks payable to WUNF. The deposit slip for the checks listed a $100.00 deposit, less $50.00 in cash. Ballard admitted to making the deposit but no explanation was given for the withdrawal. In the second item, Ballard flew to Kentucky to receive parts for WUNF. The flight charges, according to Rosenberg, were charged to WUNF without authority. In addition, a student, Tom Speed, flew with Ballard and paid Ballard $20.00 for the flight. It is alleged that Ballard never deposited this fare in the account for WUNF. See related story on page 5. Dean of Students, Dr. Thomas C. Dula has resigned and will leave to take over the presidency of Tennessee Military Institute effective July 1. Dr. Dula joined the staff of the Asheville campus of the Consolidated University in 1966 when the school was Asheville-Biltmore College. He came to Asheville after serving as assistant superintendant of Catholic Schools in St. Augustine, Florida. Dula, in taking the post at TMI is returning to a school he first attended as a student and later served at as teacher ans coach. Chancellor Highsmith, in announcing the resignation of Dula, expressed regret and noted that Dula had “played a key role on the campus in its developing years...” Dula’s decision comes after announcement earlier this year by Ed Harris that he, too, wiU be leaving UNC-A to continue his study. Harris serves as Administrative Assistant to the Chancellor. No replacements for either of the administrators have as yet been named.
